위키리더

'위키리더(WikiReader)'라는 것이 세상에 나온 모양이다. 가격은 미화 99달러이니 약 10만원이 조금 넘는다. 인터넷 접속 없이 '위키피디아(Wikipedia)'에 올려져 있는 약 3백만 타이틀의 내용을 간단하게 검색할 수 있다고 소개되어 있다.

 

위키피디아는 잘 알려져 있듯이, 웹 2.0 방식으로 콘텐츠가 쌓이는 것이다. 그것의 기본은 공유와 참여의 방식으로 웹 기반의 정보를 축적해나가는 것이다. 위키피디아의 내용을 확인할 때 인터넷에서 접속한 상태에서 확인하게 되는데, 위키리더는 그냥 오프라인에서 위키피디아의 내용을 확인할 수 있도록 한다는 것이다. 발상이 참신하다. 하지만 다른 한편으로는 금광을 캐러 서부로 몰려간 사람들에게 청바지를 팔았던 사람들의 놀라운 '상술'을 보는 것 같다. 누리집 에 소개된 내용을 보니 위키피디아의 내용을 간단하게 검색할 수 있도록 만든 전자사전 같다.

 

영어판 위키피디아의 내용은 상당한 수준에 이른 것이 사실이다. 그런 내용을 활용하자는 발상은 그 자체로 새로운 것은 아닐 것이다. 하지만 한글판 위키피디아의 내용은 조금씩 개선되고 있다고는 하지만, 부실하기 짝이 없다.

 

공공의 지적 자산을 쌓아나가는 데 한국의 누리꾼들은 별로 관심이 없기 때문일까? 아니면 네이버의 지식in와 같은 즉문즉답 형식에 익숙하기 때문일까? 전자의 원인이 더 큰 것 같다는 게 현재의 내 생각이다. 나는, 우리 사회가 근대화의 과정 속에서, 무위의, 돈으로 환산되지 않는 노동의 가치에 대해 인색해졌다고 하는 평가에 동감하는 편이다.

 

웹2.0에 기반한 콘텐츠의 부실, 그런 부실의 원인이 된 어떤 인색함. 이런 상황 속에서 위키리더와 같은 기기의 발명(?)은 당장에는 어려운 일일 뿐만 아니라, 소개된다고 해도 쉽게 받아들여지지 않을 듯싶다. 다만 변수가 있다면, 한국의 영어열풍이 있다고 할까?

인터넷 40주년

10 월 29 일, 인터넷 탄생 40 주년을 맞이하여 미국 UCLA에서 기념 행사가 열렸다.

1969 년 10 월 29 일, UCLA가 인터넷의 원형인 ARPANET (국방부 군사네트워크)로 첫번째 데이터 통신을 보냈다. UCLA는 이것을 인터넷의 시작으로 보고 있는 것이다. 최초의 통신은 이 학교와 SRI(스탠포드연구소) 사이에 이루어졌다. UCLA의 학생이 SRI 시스템에 로그인하기 위해 "LOG"를 입력하고 SRI이 "IN"을 입력 예정이었다. 하지만 UCLA 측이 "L" "O"를 보내, "G"를 입력하는 때에 시스템이 충돌하여 "LO"가 인터넷으로 전송되는 첫번째 메시지가 되었다고 한다.

the Birth of the Internet

It all began with a comic book! At the age of 6, Leonard Kleinrock was reading a Superman comic at his apartment in Manhattan, when, in the centerfold, he found plans for building a crystal radio. To do so, he needed his father's used razor blade, a piece of pencil lead, an empty toilet paper roll, and some wire, all of which he had no trouble obtaining. In addition, he needed an earphone which he promptly appropriated from a public telephone booth. The one remaining part was something called a "variable capacitor". For this, he convinced his mother to take him on the subway down to Canal Street, the center for radio electronics. Upon arrival to one of the shops, he boldly walked up to the clerk and proudly asked to purchase a variable capacitor, whereupon the clerk replied with, "what size do you want?". This blew his cover, and he confessed that he not only had no idea what size, but he also had no idea what the part was for in the first place. After explaining why he wanted one, the clerk sold him just what he needed. Kleinrock built the crystal radio and was totally hooked when "free" music came through the earphones - no batteries, no power, all free! An engineer was born.

 

Leonard Kleinrock spent the next few years cannibalizing discarded radios as he sharpened his electronics skills. He went to the legendary Bronx High School of Science and appended his studies with courses in Radio Engineering. When the time came to go to college, he found he could not afford to attend, even at the tuition-free City College of New York (CCNY), and so he enrolled in their evening session program while working full time as an electronics technician/engineer and bringing a solid paycheck home to his family. He graduated first in his class after 5 1/2 years of intense work (and was elected student body president of the evening session). His work and college training were invaluable, and led to his winning a full graduate fellowship to attend the Massachusetts Institute of Technology in the Electrical Engineering Department.

 

At MIT, he found that the vast majority of his classmates were doing their Ph.D. research in the overpopulated area of Information Theory. This was not for him, and instead he chose to break new ground in the virtually unknown area of data networks. Indeed, in 1961, he submitted a Ph.D. proposal to study data networks, thus launching the technology which eventually led to the Internet. He completed his work in 1962 which was later published in 1964 by McGraw-Hill as an MIT book entitled "Communication Nets". In this work, he developed the basic principles of packet switching, thus providing the fundamental underpinnings for that technology. These principles (along with his subsequent research) continue to provide a basis for today's Internet technology. Kleinrock is arguably the world's leading authority and researcher in the field of computer network modeling, analysis and design and a father of the Internet.

 

But the commercial world was not ready for data networks and his work lay dormant for most of the 1960's as he continued to publish his results on networking technology while at the same time rising rapidly through the professorial ranks at UCLA where he had joined the faculty in 1963. In the mid-1960's, the Advanced Research Projects Agency (ARPA) - which was created in 1958 as the United States' response to Sputnik - became interested in networks. ARPA had been supporting a number of computer scientists around the country and, as new researchers were brought in, they naturally asked ARPA to provide a computer on which they could do their research; however, ARPA reasoned that this community of scientists would be able to share a smaller number of computers if these computers were connected together by means of a data network. Because of his unique expertise in data networking, they called him to Washington to play a key role in preparing a functional specification for the ARPANET - a government-supported data network that would use the technology which by then had come to be known as "packet switching".

 

The specification for the ARPANET was prepared in 1968, and in January 1969, a Cambridge-based computer company, Bolt, Beranek and Newman (BBN) won the contract to design, implement and deploy the ARPANET. It was their job to take the specification and develop a computer that could act as the switching node for the packet-switched ARPANET. BBN had selected a Honeywell minicomputer as the base on which they would build the switch.

 

Due to Kleinrock's fundamental role in establishing data networking technology over the preceding decade, ARPA decided that UCLA, under Kleinrock's leadership, would become the first node to join the ARPANET. This meant that the first switch (known as an Interface Message Processor - IMP) would arrive on the Labor Day weekend, 1969, and the UCLA team of 40 people that Kleinrock organized would have to provide the ability to connect the first (host) computer to the IMP. This was a challenging task since no such connection had ever been attempted. (This minicomputer had just been released in 1968 and Honeywell displayed it at the 1968 Fall Joint Computer Conference where Kleinrock saw the machine suspended by its hooks at the conference; while running, there was this brute whacking it with a sledge hammer just to show it was robust. Kleinrock suspects that that particular machine is the one that was delivered by BBN to UCLA.) As it turns out, BBN was running two weeks late (much to Kleinrock's delight, since he and his team badly needed the extra development time); BBN, however, shipped the IMP on an airplane instead of on a truck, and it arrived on time. Aware of the pending arrival date, Kleinrock and his team worked around the clock to meet the schedule. On the day after the IMP arrived (the Tuesday after Labor Day), the circus began - everyone who had any imaginable excuse to be there, was there. Kleinrock and his team were there; BBN was there; Honeywell was there (the IMP was built out of a Honeywell minicomputer); Scientific Data Systems was there (the UCLA host machine was an SDS machine); AT&T long lines was there (we were attaching to their network); GTE was there (they were the local telephone company); ARPA was there; the UCLA Computer Science Dept. administration was there; the UCLA campus administration was there; plus an army of Computer Science graduate students was there. Expectations and anxieties were high because, everyone was concerned that their piece might fail. Fortunately, the team had done its job well and bits began moving between the UCLA computer and the IMP that same day. By the next day they had messages moving between the machines. THUS WAS BORN THE ARPANET, AND THE COMMUNITY WHICH HAS NOW BECOME THE INTERNET!

 

A month later the second node was added (at Stanford Research Institute) and the first Host-to-Host message ever to be sent on the Internet was launched from UCLA. This occurred in early October when Kleinrock and one of his programmers proceeded to "logon" to the SRI Host from the UCLA Host. The procedure was to type in "log" and the system at SRI was set up to be clever enough to fill out the rest of the command, namely to add "in" thus creating the word "login". A telephone headset was mounted on the programmers at both ends so they could communicate by voice as the message was transmitted. At the UCLA end, they typed in the "l" and asked SRI if they received it; "got the l" came the voice reply. UCLA typed in the "o", asked if they got it, and received "got the o". UCLA then typed in the "g" and the darned system CRASHED! Quite a beginning. On the second attempt, it worked fine!

 

Little did those pioneers realize what they had created. Indeed, most of the ARPA-supported researchers were opposed to joining the network for fear that it would enable outsiders to load down their "private" computers. Kleinrock had to convince them that joining would be a win-win situation for all concerned, and managed to get reluctant agreement in the community. By December 1969, four sites were connected (UCLA, Stanford Research Institute, UC Santa Barbara, and the University of Utah) and UCLA was already conducting a series of extensive tests to debug the network. Indeed, under Kleinrock's supervision, UCLA served for many years as the ARPANET Measurement Center (in one interesting experiment in the mid-1970's, UCLA managed to control a geosynchronous satellite hovering over the Atlantic Ocean by sending messages through the ARPANET from California to an East Coast satellite dish). As head of the Center, it was Kleinrock's mission to stress the network to its limits and, if possible, expose its faults by "crashing" the net; in those early days, Kleinrock could bring the net down at will, each time identifying and repairing a serious network fault. Some of the faults he uncovered were given descriptive names like Christmas Lockup and Piggyback Lockup. By mid-1970, ten nodes were connected, spanning the USA. BBN designed the IMP to accommodate no more than 64 computers and only one network. Today, the Internet has millions of computers and hundreds of thousands of networks! Electronic mail (email) was an ad-hoc add-on to the network in those early days and it immediately began to dominate network traffic; indeed, the network was already demonstrating its most attractive characteristic, namely, its ability to promote "people- to-people" interaction. The ARPANET evolved into the Internet in the 1980's and was discovered by the commercial world in the late `80's; today, the majority of the traffic on the Internet is from the commercial sector, whereas it had earlier been dominated by the scientific research community. Indeed, no one in those early days predicted how enormously successful data networking would become.

 

In the ensuing years since those pioneering days that led to the birth of the Internet, Kleinrock has continued as a prime mover at the frontier of the Internet and its growth and development. He has provided an international brain trust of Ph.D. graduates (39 to date) who populate major laboratories, universities and commercial organizations and who continue to advance the state of the art in networking. As one of the youngest members elected to the National Academy of Engineering, he was a founding member of the National Research Council's elite Computer Science and Telecommunications Board (CSTB). He chaired the committee that produced this Board's first report, "Towards a National Research Network"; in presenting the findings of this landmark report, he testified for then Senator Al Gore, which precipitated the Gigabit Networking component of the US Government's High Performance Computing and Communications Initiative.

 

Today, four events have juxtaposed to create a crucial juncture. First, the Internet has exploded in use and reach (and no one controls the Internet, no one owns it, no one can "shut it off"). Second, the US Administration has vigorously promoted a vision of the Information Superhighway (the National Information Infrastructure - NII). Third, the entertainment industry, along with the telephone and cable TV industries, have recognized that there is a massive business opportunity in network-based entertainment. Fourth, the telecommunications networks have been deregulated. Indeed, the Internet and the World Wide Web are household words. The result is that huge sums of money are about to be expended by the private sector to wire up the USA. In the face of this, there are some basic questions as to what is the proper vision of future networking, what is the technology framework needed to realize that vision, who will design and deploy it, whom will it serve and how, what kinds of applications and services will it support, what is the role of government and of the private sector, etc. Once again, Leonard Kleinrock is leading the effort here by way of a National Research Council CSTB committee that he chaired, and that produced the widely circulated 1994 report "Realizing the Information Future; The Internet and Beyond". This report took the country by storm, and he briefed many government and industry groups regarding its recommendations. Kleinrock's goal this time is to help formulate the guidance needed to bring the networking technology that he pioneered to society and industry for the greater good of this country and of the world.

More recently, Kleinrock has taken the leading role in the new technology of Nomadic Computing and Communications; the idea is to create a technology that will support the nomadic user in his computing and communication needs as he travels from place to place.

 

The potential impact of a ubiquitous information infrastructure is unbounded. The nature of the services and styles it can produce is limited only by the imagination of its practitioners. Kleinrock has always worked at the frontier of new technology. He chooses not to follow, fill-in, patch-up or catch-up. Rather, he takes the lead and opens up vast new technologies that have impact and excitement. Kleinrock has provided the leadership and vision to help bring this about .

갑갑증

네이버가 일본에 진출했다는 이야기는 꽤 오래 전에 들었으나 어떤 성과를 거두었는지 이야기를 들어본 적이 없다. 나라마다 독특한 검색의 '습관'이 있지만, 지금 한국의 '독특한 인터넷 환경'이 세계적으로 어떤 위상 속에 있는지 잘 파악되지 않는다.

 

내가 느끼는 것은 '갑갑하다'는 것이다. 그리고 그 '갑갑증'은 여러 가지 원인이 있다고 생각하고 있다. 서비스 업체의 문제이기도 하고, 정부의 갖가지 규제 때문이기도 하다.(그런데 그렇게도 규제 완화를 외치는 정부가 왜 인터넷에서만은 예외가 되는 것일까?)

 

오늘 강인규--<나는 스타벅스에서 불온한 상상을 한다>는 책의 저자인지 오마이뉴스의 기사만으로는 분명치 않다.<나는 스타벅스에서 불온한 상상을 한다>의 책날개에는 저자 강인규가 위스콘신대학의 강사인 미디어 학자다--의 짤막한 글, 트위터 '2등'으로 밀어낸 한국... 뿌듯해?라는 글을 읽었다. 이 글은 한겨레신문의 기사, 트위터도 당한 고추장 마케팅이라는 기사에 대한 문제제기의 성격을 지니고 있다. 사실 한겨레의 기사는 흥미로운 기사이기는 하지만, 좋은 기사라는 생각이 들지 않는 기사다. 왠지 '민족주의적'이다. 그리고 이 한겨레의 기사는 한국의 '독특한 인터넷 환경'이 지닌 문제점을 거론하지 않고 있다. 이 점을 강인규 씨는 지적하고 있다. 최근 국정원이 이메일뿐만 아니라 메신저까지 감청한다고 하니, 그 독특함에 기이한 독특함까지 더욱 더해질 거라는 생각뿐이다. 외국 서비스의 진입만 어렵게 하는 것이 아니라, 외국 진출도 불가능하게 만드는 '한국적 환경'은 어떤 환경인가라는 질문!

비표준 기술, 독과점과 담합에 의한 시장왜곡, 표현의 엄격한 규제 등 한국의 독특한 환경에 '최적화된' 서비스는 한국 이외의 나라에서는 경쟁력을 갖기 어렵다. (한국과 비슷한 환경을 가진 '형제국가' 한두 군데를 찾을 수 있을지 모르겠다.) 문제는 '한국적 환경'이 외국 서비스의 진입만 어렵게 하는 것이 아니라, 외국 진출도 불가능하게 한다는 점이다.

 

네이버의 일본시장 실패나 싸이월드의 미국과 유럽시장 실패에서도 보듯, 한국의 인터넷 서비스가 국제적 성공을 거둔 사례는 전무하다. 앞으로 전망은 더욱 어둡다. 게다가 한국이 경쟁력을 갖고 있던 하드웨어 분야는 급속도로 소프트웨어 중심으로 재편되고 있다.

 

예컨대 휴대폰 산업은 애플이나 구글처럼 소프트웨어 기반업체들의 지배권 밑으로 편입되고 있다. 이제 제대로 된 인터넷 기반 플랫폼을 갖추지 못한 하드웨어 기업은 소프트웨어 업체의 하청공장으로 전락하는 신세가 될 것이다. 세계 최강의 휴대폰 업체인 노키아 주식이 올 들어 16퍼센트 하락한 것은 이런 분위기를 잘 말해준다.

 

삼성과 엘지 등의 하드웨어 업체들이 긴장해야 할 이유가 여기에 있다. (사실 '심비안'이라는 자체 플랫폼을 가진 노키아는 한국의 어떤 업체보다 나은 상황이다.) '토종'도 좋고, '삼성 만세'도 좋지만, 한국이 현재 어떤 상황에 있는지 객관적으로 돌아볼 필요가 있다.

백과사전의 미래

지금은 웹2.0 시대다. 이런 시대에 백과사전의 미래는 어떻게 되는 것일까?

 

240년의 역사를 자랑하는 브리태니커가 마침내 웹 2.0의 세계로 돌입한다는 내용의 기사와 마주쳤다. 아래 인용해놓은 <타임즈 온라인>에 따르면, 브리태니커의 Jorge Cauz 사장은 '브리태니커 2.0'은 위키피디아의 방식을 도입하는 것이라고 한다. 하지만 브리태니커가 곧 위키피디아가 되는 것은 아니라는 점을 분명하게 밝히고 있다.

 

익명의 집필자가 집필하고 편집하는 위키피티아의 방식이 아니라 브리태니커의 편집자들이 기사들을 점검할 것이라는 점을 강조하고 있다. 정보의 신뢰성을 높이고자 하는 브리태니커만의 방식을 웹2.0 시대에도 고수하겠다는 것이다. 현재 브리태니커에는 약 2,500-4,500명의 전문 집필자들이 참여하고 있는데, 그 집필자의 폭은 넓어질 것으로 예상된다. 간단히 말해서 집필자의 폭은 웹2.0 시대에 맞게 넓혀나가지만 편집자의 역할을 고수하겠다는 방침인 것이다.

 

이 기사에 따르면, 위키피디아의 하루 이용자가 약 6백만 명인데 반해 등록 후 이용하게끔 되어 있는 브리태니커의 하루 이용자가 1백5십만 명이나 된다는 사실은 조금 놀랍다. 이 수치는 그만큼 브리태니커 사전에 대한 신뢰성이 웹2.0 시대에도 요구되고 있다는 현실을 보여주는 것일 터이다. Jorge Cauz 사장은 '편집자와 독자의 공생적 관계(symbiotic relationship between editor and reader)'를 중요하게 언급하고 있다.

 

약 6개월 뒤에 그 모습을 드러낼 브리태니커2.0은 어떤 모습일까?

The 240-year-old Encyclopaedia Britannica has taken a giant leap into the world of Web 2.0 with the launch of a new online version where users can contribute and edit content.

 

In a move that takes it head to head with Wikipedia, new features on the Britannica site will allow users to edit and contribute articles in return for the glory of having their name attached to the submission.

 

However, “voyeuristic” Wikipedia fans ought not to get too excited by the changes as all submissions will undergo a strict vetting process and may or may not make the cut, according to Britannica 's president, Jorge Cauz.

 

“We’re not trying to be a wiki - that’s the last thing we want to be,” Mr Cauz told The Times.

 

“Britannica doesn’t offer that voyeuristic benefit. Users won’t be able to write anything they want and have it published. Each contribution will be verified and fact checked by our editors.”

 

Mr Cauz said the Britannica site was “definitely not as popular” as Wikipedia, attracting about 1.5 million people each day compared with Wikipedia’s approximate 6 million visitors a day.

 

“But we’re not trying to be a tabloid or reality TV [type of product]. We are a different type of animal, catering to a different type of crowd," he said.

 

“Wikipedia contributes to the spread of information and many people are happy with it as their only source of reference – as are many people happy to eat McDonalds every day.”

 

While Britannica will continue to rely heavily on its 2500 - 4500 regular experts to write the bulk of its content, Mr Cauz said he hoped that with the wide reach of the web it can tap into many more potential contributors.

 

“Britannica is widely used in the academic market. Many of the top universities around the world have access to it. We want to tap into the many experts that may have something to say that could improve our content.

 

“I think the future is likely going to be that in every media segment there has to be a symbiotic relationship between editor and reader,” he said.

 

Articles submitted by non-academic users will sit in a separate section to expert-generated Britannica content, as will content submitted by non-Britannica scholars.

 

There will also be a robust history attached to each article with details of the changes made and who made them.

 

“We really want to make sure that there is a certain amount of accountability from contributors,” Mr Cauz said.

 

Other features Britannica plans to roll out over the next six months include a comprehensive list of contributors by subject area, the ability for users to post questions to contributors, and an article rating system.

 

Mr Cauz said the changes to the site were triggered by the volume of feedback Britannica had been getting from its readers.

 

“We found people were really trying to engage with Britannica. We received lots of letters to the editor from readers offering advice on how to improve articles and picking up factual errors. We noticed readers were really starting to participate in the editorial process.

 

“The reason it took us a long time to create a more user interactive website is because of the amount of technology required to ensure the changes are implemented in an expeditious manner. 상호작용과 관계맺기-social media politics

한 공중파 방송국이 마련한 '대통령과의 원탁대회, 어떻게 생각하십니까'의 임시 누리집에 대해 오늘 누리꾼들은 분통을 터뜨렸다.

 

"대통령에게 바란다라는 제목으로 마련한 시청자 게시판 역시 성토의 장으로 변하고 있다. 이 대통령을 비판하는 내용의 글을 넘어, 게시글을 '비공개'로 처리하면서 '일방통행'에 대한 비판적 목소리가 확산되고 있는 것"이라고 한 인터넷신문은 전하고 있다. 한 누리꾼은 "너만 읽으면 된다 이거야? 이것도 소통이냐?" 라고 꾸짖고 있다고 한다. (참고: http://www.jabo.co.kr/sub_read.html?uid=26509&section=sc3&section2=)

 

정치인들의 미디어 활용의 역사는 미디어의 발전사에 중요한 궤적을 남기고 있다. 로마의 정치인들은 유창한 말로 광장에 모인 시민들의 호응을 끌어내면서 자신의 정치적 입지를 넓히고 굳혔다. 구텐베르크의 인쇄술은 그리스 도시국가의 한 정치적 시스템이었던 '민주주의'를 인류 보편의 것으로 확장시켰다. 소수자의 목소리도 팸플릿의 형태로든 책자의 형태로든 널리 알릴 수 있는 길을 열었던  것이다.

 

그리고 신문과 방송의 시대가 열렸다. 매스미디어(mass media)는 여론 형성의 주된 창구였다. 20세기 가장 위대한 사상가이자 정치인이라 할 수 있는 간디는 언론인이기도 하였다. 그의 주저 가운데 하나인 <힌두 스와라지>의 제1장에서도 간디는 언론의 사명을 명토박아 설명하고 있다.

아돌프 히틀러(1889-1945)와 프랭클린 루즈벨트(1882-1945)는 라디오를 활용했다. 루즈벨트의 '노변정담(Fireside chat)'은 새로운 미디어를 활용하여 국민들을 직접 설득해보고자 하는 정치인의 미디어 활용의 대표적인 사례다. 존 F. 케네디(1917-1963)는 텔레비전을 활용했다. JFK와 닉슨의 선거전에서 텔레비전이라는 새로운 미디어의 속성을 제대로 이해하지 못한 닉슨이 패배할 수밖에 없었다는 미디어학계의 지적은 꽤나 오래 된 것이다.  그런 의미에서 새로운 미디어의 본질과 속성을 이해하지 못하는 정치인의 전형으로 닉슨을 꼽는 것도 무리는 아니다.

 

그리고 또 다른 새로운 미디어가 출현했다. 인터넷!

 

한국의 정치현실에서 미디어와 정치인이 어떻게 만나고 있는가. 어느 정치인은 이렇게 말한 바 있다. "대통령은 저녁 10시 이후가 대단히 중요한 데 DJ는 관저에서 9시 뉴스를 시청하고 10시부터는 신문과 각종 보고서를 탐독했다" "반면 김영삼 전 대통령께서는 알려진 대로 특정인과 대화를 나눴고, 노 대통령은 인터넷을 하는 게 아닌가 싶다."(http://www.donga.com/fbin/output?n=200706120241) 실상 '사이버 대통령'이라는 표현이 나올 정도로 노무현 전 대통령의 인터넷 활용은 국내뿐만 아니라 국외에서도 꽤나 연구대상이 아니었나 싶다.

 

이번에 버락 오바마 미국 대통령의 미디어 활용은 여기서 한 걸음 더 나아간 것으로 보인다. 노무현 전 대통령 때보다도 인터넷 기술은 더욱 발전했고, 그 발전의 핵심은 '사회적 네트워킹 시스템(Social Networking System, SNS)'이다. 오바마와 존 매케인의 선거전은 SNS를 기반으로 하는 사회적 미디어(social media)와 매스미디어의 대결이었다고 할 수도 있을 것이다. 불과 며칠 전에 백악관에 입성한 오바마의 참모진들이 이 사회적 미디어를 어떻게 활용하고 있는가는 요 며칠 나의 관심사항이기도 하였다.

오바마의 미 행정부의 정권인수팀의 누리집  Change.gov 에 리스트 관리와 스프레드시트를 제공하던 start-up 기업인 blist의 CEO인 케빈 메리트(Kevin Merritt)가 TechCrunch에 올린 글을 한 블로거가 번역했다. 어찌 보면 블리스트를 자랑하면서 마케팅을 하고 있는 듯이 느껴지기도 하지만, 정부와 기업과 NGO가 앞으로 어떤 원칙을 견지하면서 사회적 네트워킹 시스템을 활용할 것인가에 대하여 좋은 참조가 될 듯싶다.

One significant addition to WhiteHouse.gov reflects a campaign promise from the President: we will publish all non-emergency legislation to the website for five days, and allow the public to review and comment before the President signs it.

금주에 버락 오바마 대통령은 미국의 44대 대통령으로써 선서했다.  백악관에서 처음 며칠동안 몇 가지 기술적인 도전이 있었음에도 불구하고, 오바마 집행부는 전례가 없는 방법으로 기술을 활용할 것이다.  미래지향적인 뛰어난 웹 전문가들이 이끄는 오바마의 새로운 미디어팀은 매우 탄탄해 보이며, 오픈소스 민주주의라는 오바마의 비전을 실행할 준비가 되어있다.

 

오바마의 선서에 맞추어, 오바마 집행부의 새로운 미디어팀은 화요일 동부시각으로 오후 12:01에 whitehouse.org의 운영을 시작했다. 이것은 현 집행부의 공식 웹사이트이다. 새로운 미디어팀은  새 집행부의 세가지 원칙이 커뮤니케이션, 투명성 그리고 참여임을 확인시켜 주었다. 지금부터 이 세가지 원칙을  달성하기 위해 새 집행부가 웹 기술을 어떻게 활용하는 지 살펴보겠다.

 

커뮤니케이션. 이 집행부는 캠페인 기간은 물론 선거 승리 후에도 더이상 AM 라디오를 듣지 않는 미국인 세대와 글로벌 시민을 위한 인터넷 비디오를 위해 구글의 유튜브를 활용했다.  오바마 대통령은 그의 방송대담을 비디오로 녹화하고 그것을 유튜브와 그 외 동영상 사이트에 배포할 것을 맹세했다. 새 집행부는 WhiteHouse.gov 이양 작업을 통해 통해 사상 처음으로 백악관 공식 블로그를 온라인에 올렸다.  당신은 이메일 업데이트를 통해 대통령의 새소식을 들을 수 있다. 블로그를 통해, 오바마는 RSS 피드를 가진 첫번째 미국 대통령이 되었다!

투명성. 오바마는 현재 가장 열려있고 정직하고 투명한 집행부를 운영할 것을 약속하고 있다. 선거 캠페인 사이트인 CHANGE.GOV의 Your Seat at The Table 섹션을 통해, 오바마의 팀은 오바마 대통령 투표 때처럼 1분에 수백개의 개인적인 미팅을 올리고 있다. 심지어는, 특별히 다르게 명기된 경우가 아니라면, CHANGE.GOV site의 모든 컨텐츠는 Creative Commons Attribution 3.0 License을 가지고 광범위하게 공개되고 있다. 오바마-바이든 정권 이양팀은 정권 이행 프로젝트의 모든 기부자들을 공개하기 위해서 나의 회사, blist를 이용했다.  두가지 기록할만한 키 포인트는 공개는 모두 자발적으로 이루어졌고 그들이 사용하기로 한 툴은 데이터를 대중들이 보다 많이 사용할 수 있도록 해주었다는 점이다. 대용량에 번거롭고 작업하기 어려운 일반 HTML 도표에 비교해 볼 때, blist 위젯으로 배포된 데이터는 쉽게 정리되고 검색되고 걸러지고 다운로드할 수 있고 인쇄할 수 있고 이메일로 보낼 수 있고 다시 배포할 수 있었다 - 이러한 것들은 예전에는 공개 데이터를 다루는 많은 이용자들이 쉽게 즐길 수 없던 기능이었다.

 

참여. 오바마 집행부는 쌍방향 정부로서의 굵직한 경험을 진행하고 있었다. President Barack Obama was sworn into office this week as our nation’s 44th president.  Despite running into a few technical challenges in the first few days at the White House, the Obama Administration will embrace technology in unprecedented ways. Led by forward thinking, web savvy technologists, President Obama’s new media team looks poised and ready to fulfill President Obama’s vision of open-source democracy.

 

Coincident with Mr. Obama being sworn in, the Obama Administration’s new media team assumed control of WhiteHouse.gov at 12:01 PM EST on Tuesday.  This is the official website of the sitting administration. The new media team has identified three top priorities of the new administration – communication, transparency and participation. Let’s examine how the new administration has been leveraging web technologies to meet these priorities.

 

Communication. This administration’s use of Google’s YouTube during both the campaign and after winning the election leverages Internet video to reach a generation of Americans and global citizens who no longer tune in to AM radio on a regular basis. President Obama has vowed to continue video recording his fireside chats and publishing them via YouTube and other video sites. With the transition of WhiteHouse.gov to the new administration, for the first time ever an official White House blog came online. You can sign up for email updates from the president. Through the blog, Mr. Obama is the first U.S. president to have an RSS feed!

During the campaign President Obama relied heavily on Facebook, Myspace and Twitter to build support, communicate with constituents and develop a core audience. By far, Mr. Obama has more followers on Twitter than anyone else (168,000). His fan page on Facebook has more than 4 million fans.

 

Transparency. Mr. Obama promises to run the most open, honest and transparent administration to date. Through the Your Seat at The Table section on the CHANGE.GOV transition site, the Obama transition team posted the minutes of hundreds of private meetings with then President-Elect Obama.

Even all of the content on the CHANGE.GOV site, unless otherwise noted, is licensed to the public at large via a Creative Commons Attribution 3.0 License.

The Obama-Biden Transition Team used my company, blist, to disclose the names of all donors to the transition project. Two key points of note are that the disclosure was entirely voluntary and the tool they chose to use made the data itself much more consumable by the mainstream public. Compared to a plain HTML table, which is bulky, cumbersome and hard to work with, by publishing the data via a blist widget the data can easily be sorted, searched, filtered, downloaded, printed, emailed and even republished – all capabilities not previously enjoyed by most consumers of public data sets.

 

Participation. The Obama Administration has been conducting bold experiments in interactive government. The Citizen’s Briefing Book, powered by Salesforce.com, has allowed citizens to suggest topics Mr. Obama should consider upon taking office. Once a topic was submitted, other visitors to the Citizen’s Briefing Book could vote the topic up or down and comment on it. Voting, ranking and commenting are hallmark features of web-based, social media applications.

The new Administration has brought forth a new era of honest, open, participatory and transparent government by creatively employing web-based software from innovative companies like Google, Facebook, Salesforce.com and blist. We’re eager to see the use of these technologies extended to WhiteHouse.gov initially and from there we’d love to see more government agencies quickly embrace web technologies to promote communication, transparency and participation.

바야흐로 오픈소스 민주주의의 현실을 우리는 지켜보고 있는 것이다. 그리고 매스미디어에 바탕을 둔 '대중정치(mass politics)'에서 사회적 네트워킹 시스템을 기반으로 하는 '사회적 미디어 정치(social media politics)'로 바뀌어가고 있는 현실을 목도하고 있는 것이다.

 

이미 낡아버린 매스 폴리틱스의 굳어버린 관습에 얽매인 사람들의 눈에는 이것이 잘 보이지 않는 모양이다. 그래서 '사회적 미디어 정치'의 새로운 물결을 어떤 식으로든 막아보려고 애쓰고 있다. 하지만 그것이 잘 될까?

 

'사회적 미디어 정치'의 본질은 무엇일까? 그것은 상호작용(interaction)과 사회화 즉 관계맺기(socialization)일 것이다. 그리고 형식이 아니라 내용이 중요하다. 내용 즉 메시지, 콘텐츠!. 대화를 나누되, 대화의 형식이 아니라 대화의 내용이 문제인 것이다.

구글과 책의 미래

 

2008년 10월 28일 뉴욕 발 보도에 따르면, 구글과 미국작가협회, 미국출판인협회는 구글 도서검색에 참여하는 미국 주요 도서관의 장서목록에 있는 수백만 권의 저작권 서적 및 기타 문서자료에 대한 온라인 접근권을 확대한다는 내용에 합의했다고 발표했다고 한다. 이러한 합의에 이르기까지 미국출판인협회를 대표한 대형 출판업체 5곳의 소송이 있었고, 2년 간의 긴 협상이 있었다. 이 합의에 따라 집단소송은 취하될 것이라 하였다.


구글 도서검색은 웹 상에서 수백만 권의 서적을 검색할 수 있도록 하기 위한 기획으로 너무나도 잘 알려져 있다.

 

이번 합의의 효력은 다음과 같다고 한다.

 

-절판 서적에 대한 접근권 향상 : 희귀 서적 및 절판 서적을 온라인 상에서 검색하고 일부 내용을 볼 수 있도록 함으로써 수백만 권의 작품을 대중에 소개할 수 있다.

-저작권의 보호를 받는 서적의 구매 방식 확대 : 사용자들이 서적에 대한 온라인 접근권을 구매할 수 있도록 해 출판업자 및 작가들의 미국 내 도서 전자시장 확대 노력에 기여한다.
-대학 및 기관에 수백만 권의 서적에 대한 온라인 구독권 제공: 미국 대학 및 기타 기관들이 보유하고 있는 세계적인 장서들에 대한 온라인 구독권을 운영할 수 있도록 한다.
-미국 도서관에서 무료로 열람 가능 : 미국 공립 도서관 및 대학 도서관의 지정된 컴퓨터에서 수백만의 절판 서적 전문을 무료로 열람할 수 있다.
-작가 및 출판업체에 보상 지급 및 작품 접근권에 대한 통제권 부여 :
구글 도서검색 및 향후 다른 기업의 유사 프로그램이 제공하는 온라인 접근권으로부터 창출된 수익은 새로이 출시된 독립 비영리 기관인 '도서권리등록기관(Book Rights Registry)'을 통해 관리한다. 이에 따라, 저작권 소유자를 파악하고 정확한 정보를 수집, 관리함으로써 그들이 프로젝트에 참여 혹은 탈퇴할 수 있도록 한다.

 

이번 합의에 근거해 구글은 총 1억 2500만 불을 지불할 예정이다. 이는 도서권리등록기관을 설립하는데 사용되며, 작가 및 출판업체들의 요구사항을 해결하고 법적 비용을 충당하는데도 사용될 것이라 한다. 전 세계의 미국 저작권자들은 도서권리등록기관에 자신의 작품을 등록함으로써, 보상을 받을 수 있다. 기관 구독비 및 도서 판매, 광고 매출, 그 외 매출 모델에 따라 보상금이 지급되며, 작품이 이미 디지털화 된 경우에는 현금으로 지급 받을 수 있다고 한다.

 

앞으로 미국 내의 많은 도서관들이 구굴의 프로젝트에 추가적으로 참여하게 될 것으로 기대된다.

 

보도에 따르면 이번 합이에 대한 미국작가협회, 미국출판인협회, 그리고 구글의 반응은 다음과 같다.

 

로이 블론트 주니어 (Roy Blount Jr.) 미국작가협회 사장은 “집필은 어려운 일이며, 집필을 통해 돈을 버는 것은 더욱 어려운 일”이라면서, “독자이자 학자의 한 명으로서 앞으로 세계적인 도서관들의 온라인 장서 목록을 살펴보기 위해 기쁜 마음으로 지역도서관에 들르게 될 것이다. 작가의 한 명으로서는 사람들이 우리의 작품을 활용하고 그 대가를 지불할 것이라는 사실을 감사히 생각한다. 이번 합의는 올바른 결정이었다”고 덧붙였다.

 

리차드 사르노프 (Richard Sarnoff) AAP 화장은 “이번 합의는 모두를 위한 역사적인 결정”이라면서, “이번 합의를 통해 급변하는 디지털 세계의 저작권물 사용에 대한 혁신적인 기준이 탄생했다. 많은 희귀 서적에 대한 독자들의 접근권을 확대했으며, 저작권자에게 통제와 선택의 권한을 부여한 매력적인 상업모델을 구축함으로써 출판업계에 혜택을 준다”고 말했다.

 

구글의 공동 창업자이자 기술총괄 사장인 세르게이 브린(Sergey Brin)은 “구글의 미션은 전세계 정보를 체계화하여 언제 어디서나 접근과 활용이 가능하도록 하는 것이다. 오늘 우리는 작가와 출판업자, 그리고 도서관과 협력하여 이 같은 노력을 향한 커다란 진일보를 이루어냈다”면서, “이번 합의를 통해 모두가 혜택을 보게 되겠지만, 그 중에서도 독자들이 가장 큰 이익을 얻게 될 것이다. 전세계 서적에 들어있는 엄청난 양의 지식을 이제 마우스 클릭만으로 활용할 수 있게 되었다”고 덧붙였다.

How can we navigate through the information landscape that is only beginning to come into view? The question is more urgent than ever following the recent settlement between Google and the authors and publishers who were suing it for alleged breach of copyright. For the last four years, Google has been digitizing millions of books, including many covered by copyright, from the collections of major research libraries, and making the texts searchable online. The authors and publishers objected that digitizing constituted a violation of their copyrights. After lengthy negotiations, the plaintiffs and Google agreed on a settlement, which will have a profound effect on the way books reach readers for the foreseeable future. What will that future be?

 

No one knows, because the settlement is so complex that it is difficult to perceive the legal and economic contours in the new lay of the land. But those of us who are responsible for research libraries have a clear view of a common goal: we want to open up our collections and make them available to readers everywhere. How to get there? The only workable tactic may be vigilance: see as far ahead as you can; and while you keep your eye on the road, remember to look in the rearview mirror.

 

When I look backward, I fix my gaze on the eighteenth century, the Enlightenment, its faith in the power of knowledge, and the world of ideas in which it operated—what the enlightened referred to as the Republic of Letters.

 

The eighteenth century imagined the Republic of Letters as a realm with no police, no boundaries, and no inequalities other than those determined by talent. Anyone could join it by exercising the two main attributes of citizenship, writing and reading. Writers formulated ideas, and readers judged them. Thanks to the power of the printed word, the judgments spread in widening circles, and the strongest arguments won.

 

The word also spread by written letters, for the eighteenth century was a great era of epistolary exchange. Read through the correspondence of Voltaire, Rousseau, Franklin, and Jefferson—each filling about fifty volumes—and you can watch the Republic of Letters in operation. All four writers debated all the issues of their day in a steady stream of letters, which crisscrossed Europe and America in a transatlantic information network.

 

I especially enjoy the exchange of letters between Jefferson and Madison. They discussed everything, notably the American Constitution, which Madison was helping to write in Philadelphia while Jefferson was representing the new republic in Paris. They often wrote about books, for Jefferson loved to haunt the bookshops in the capital of the Republic of Letters, and he frequently bought books for his friend. The purchases included Diderot's Encyclopédie, which Jefferson thought that he had got at a bargain price, although he had mistaken a reprint for a first edition.

 

Two future presidents discussing books through the information network of the Enlightenment—it's a stirring sight. But before this picture of the past fogs over with sentiment, I should add that the Republic of Letters was democratic only in principle. In practice, it was dominated by the wellborn and the rich. Far from being able to live from their pens, most writers had to court patrons, solicit sinecures, lobby for appointments to state-controlled journals, dodge censors, and wangle their way into salons and academies, where reputations were made. While suffering indignities at the hands of their social superiors, they turned on one another. The quarrel between Voltaire and Rousseau illustrates their temper. After reading Rousseau's Discourse on the Origins of Inequality in 1755, Voltaire wrote to him, "I have received, Monsieur, your new book against the human race.... It makes one desire to go down on all fours." Five years later, Rousseau wrote to Voltaire. "Monsieur,...I hate you."

 

The personal conflicts were compounded by social distinctions. Far from functioning like an egalitarian agora, the Republic of Letters suffered from the same disease that ate through all societies in the eighteenth century: privilege. Privileges were not limited to aristocrats. In France, they applied to everything in the world of letters, including printing and the book trade, which were dominated by exclusive guilds, and the books themselves, which could not appear legally without a royal privilege and a censor's approbation, printed in full in their text.

One way to understand this system is to draw on the sociology of knowledge, notably Pierre Bourdieu's notion of literature as a power field composed of contending positions within the rules of a game that itself is subordinate to the dominating forces of society at large. But one needn't subscribe to Bourdieu's school of sociology in order to acknowledge the connections between literature and power. Seen from the perspective of the players, the realities of literary life contradicted the lofty ideals of the Enlightenment. Despite its principles, the Republic of Letters, as it actually operated, was a closed world, inaccessible to the underprivileged. Yet I want to invoke the Enlightenment in an argument for openness in general and for open access in particular.

 

If we turn from the eighteenth century to the present, do we see a similar contradiction between principle and practice—right here in the world of research libraries? One of my colleagues is a quiet, diminutive lady, who might call up the notion of Marion the Librarian. When she meets people at parties and identifies herself, they sometimes say condescendingly, "A librarian, how nice. Tell me, what is it like to be a librarian?" She replies, "Essentially, it is all about money and power."

 

We are back with Pierre Bourdieu. Yet most of us would subscribe to the principles inscribed in prominent places in our public libraries. "Free To All," it says above the main entrance to the Boston Public Library; and in the words of Thomas Jefferson, carved in gold letters on the wall of the Trustees' Room of the New York Public Library: "I look to the diffusion of light and education as the resource most to be relied on for ameliorating the condition promoting the virtue and advancing the happiness of man." We are back with the Enlightenment.

Our republic was founded on faith in the central principle of the eighteenth-century Republic of Letters: the diffusion of light. For Jefferson, enlightenment took place by means of writers and readers, books and libraries—especially libraries, at Monticello, the University of Virginia, and the Library of Congress. This faith is embodied in the United States Constitution. Article 1, Section 8, establishes copyright and patents "for limited times" only and subject to the higher purpose of promoting "the progress of science and useful arts." The Founding Fathers acknowledged authors' rights to a fair return on their intellectual labor, but they put public welfare before private profit.

 

How to calculate the relative importance of those two values? As the authors of the Constitution knew, copyright was created in Great Britain by the Statute of Anne in 1710 for the purpose of curbing the monopolistic practices of the London Stationers' Company and also, as its title proclaimed, "for the encouragement of learning." At that time, Parliament set the length of copyright at fourteen years, renewable only once. The Stationers attempted to defend their monopoly of publishing and the book trade by arguing for perpetual copyright in a long series of court cases. But they lost in the definitive ruling of Donaldson v. Becket in 1774.

 

When the Americans gathered to draft a constitution thirteen years later, they generally favored the view that had predominated in Britain. Twenty-eight years seemed long enough to protect the interests of authors and publishers. Beyond that limit, the interest of the public should prevail. In 1790, the first copyright act—also dedicated to "the encouragement of learning"—followed British practice by adopting a limit of fourteen years renewable for another fourteen.

 

How long does copyright extend today? According to the Sonny Bono Copyright Term Extension Act of 1998 (also known as "the Mickey Mouse Protection Act," because Mickey was about to fall into the public domain), it lasts as long as the life of the author plus seventy years. In practice, that normally would mean more than a century. Most books published in the twentieth century have not yet entered the public domain. When it comes to digitization, access to our cultural heritage generally ends on January 1, 1923, the date from which great numbers of books are subject to copyright laws. It will remain there—unless private interests take over the digitizing, package it for consumers, tie the packages up by means of legal deals, and sell them for the profit of the shareholders. As things stand now, for example, Sinclair Lewis's Babbitt, published in 1922, is in the public domain, whereas Lewis's Elmer Gantry, published in 1927, will not enter the public domain until 2022.[1]

 

To descend from the high principles of the Founding Fathers to the practices of the cultural industries today is to leave the realm of Enlightenment for the hurly-burly of corporate capitalism. If we turned the sociology of knowledge onto the present—as Bourdieu himself did—we would see that we live in a world designed by Mickey Mouse, red in tooth and claw.

 

Does this kind of reality check make the principles of Enlightenment look like a historical fantasy? Let's reconsider the history. As the Enlightenment faded in the early nineteenth century, professionalization set in. You can follow the process by comparing the Encyclopédie of Diderot, which organized knowledge into an organic whole dominated by the faculty of reason, with its successor from the end of the eighteenth century, the Encyclopédie méthodique, which divided knowledge into fields that we can recognize today: chemistry, physics, history, mathematics, and the rest. In the nineteenth century, those fields turned into professions, certified by Ph.D.s and guarded by professional associations. They metamorphosed into departments of universities, and by the twentieth century they had left their mark on campuses—chemistry housed in this building, physics in that one, history here, mathematics there, and at the center of it all, a library, usually designed to look like a temple of learning.

 

Along the way, professional journals sprouted throughout the fields, subfields, and sub-subfields. The learned societies produced them, and the libraries bought them. This system worked well for about a hundred years. Then commercial publishers discovered that they could make a fortune by selling subscriptions to the journals. Once a university library subscribed, the students and professors came to expect an uninterrupted flow of issues. The price could be ratcheted up without causing cancellations, because the libraries paid for the subscriptions and the professors did not. Best of all, the professors provided free or nearly free labor. They wrote the articles, refereed submissions, and served on editorial boards, partly to spread knowledge in the Enlightenment fashion, but mainly to advance their own careers.

 

The result stands out on the acquisitions budget of every research library: the Journal of Comparative Neurology now costs $25,910 for a year's subscription; Tetrahedron costs $17,969 (or $39,739, if bundled with related publications as a Tetrahedron package); the average price of a chemistry journal is $3,490; and the ripple effects have damaged intellectual life throughout the world of learning. Owing to the skyrocketing cost of serials, libraries that used to spend 50 percent of their acquisitions budget on monographs now spend 25 percent or less. University presses, which depend on sales to libraries, cannot cover their costs by publishing monographs. And young scholars who depend on publishing to advance their careers are now in danger of perishing.

 

Fortunately, this picture of the hard facts of life in the world of learning is already going out of date. Biologists, chemists, and physicists no longer live in separate worlds; nor do historians, anthropologists, and literary scholars. The old map of the campus no longer corresponds to the activities of the professors and students. It is being redrawn everywhere, and in many places the interdisciplinary designs are turning into structures. The library remains at the heart of things, but it pumps nutrition throughout the university, and often to the farthest reaches of cyberspace, by means of electronic networks.

 

The eighteenth-century Republic of Letters had been transformed into a professional Republic of Learning, and it is now open to amateurs—amateurs in the best sense of the word, lovers of learning among the general citizenry. Openness is operating everywhere, thanks to "open access" repositories of digitized articles available free of charge, the Open Content Alliance, the Open Knowledge Commons, OpenCourseWare, the Internet Archive, and openly amateur enterprises like Wikipedia. The democratization of knowledge now seems to be at our fingertips. We can make the Enlightenment ideal come to life in reality.

 

At this point, you may suspect that I have swung from one American genre, the jeremiad, to another, utopian enthusiasm. It might be possible, I suppose, for the two to work together as a dialectic, were it not for the danger of commercialization. When businesses like Google look at libraries, they do not merely see temples of learning. They see potential assets or what they call "content," ready to be mined. Built up over centuries at an enormous expenditure of money and labor, library collections can be digitized en masse at relatively little cost—millions of dollars, certainly, but little compared to the investment that went into them.

 

Libraries exist to promote a public good: "the encouragement of learning," learning "Free To All." Businesses exist in order to make money for their shareholders—and a good thing, too, for the public good depends on a profitable economy. Yet if we permit the commercialization of the content of our libraries, there is no getting around a fundamental contradiction. To digitize collections and sell the product in ways that fail to guarantee wide access would be to repeat the mistake that was made when publishers exploited the market for scholarly journals, but on a much greater scale, for it would turn the Internet into an instrument for privatizing knowledge that belongs in the public sphere. No invisible hand would intervene to correct the imbalance between the private and the public welfare. Only the public can do that, but who speaks for the public? Not the legislators of the Mickey Mouse Protection Act.

 

You cannot legislate Enlightenment, but you can set rules of the game to protect the public interest. Libraries represent the public good. They are not businesses, but they must cover their costs. They need a business plan. Think of the old motto of Con Edison when it had to tear up New York's streets in order to get at the infrastructure beneath them: "Dig we must." Libraries say, "Digitize we must." But not on any terms. We must do it in the interest of the public, and that means holding the digitizers responsible to the citizenry.

 

It would be naive to identify the Internet with the Enlightenment. It has the potential to diffuse knowledge beyond anything imagined by Jefferson; but while it was being constructed, link by hyperlink, commercial interests did not sit idly on the sidelines. They want to control the game, to take it over, to own it. They compete among themselves, of course, but so ferociously that they kill each other off. Their struggle for survival is leading toward an oligopoly; and whoever may win, the victory could mean a defeat for the public good.

 

Don't get me wrong. I know that businesses must be responsible to shareholders. I believe that authors are entitled to payment for their creative labor and that publishers deserve to make money from the value they add to the texts supplied by authors. I admire the wizardry of hardware, software, search engines, digitization, and algorithmic relevance ranking. I acknowledge the importance of copyright, although I think that Congress got it better in 1790 than in 1998.

 

But we, too, cannot sit on the sidelines, as if the market forces can be trusted to operate for the public good. We need to get engaged, to mix it up, and to win back the public's rightful domain. When I say "we," I mean we the people, we who created the Constitution and who should make the Enlightenment principles behind it inform the everyday realities of the information society. Yes, we must digitize. But more important, we must democratize. We must open access to our cultural heritage. How? By rewriting the rules of the game, by subordinating private interests to the public good, and by taking inspiration from the early republic in order to create a Digital Republic of Learning.

 

What provoked these jeremianic- utopian reflections? Google. Four years ago, Google began digitizing books from research libraries, providing full-text searching and making books in the public domain available on the Internet at no cost to the viewer. For example, it is now possible for anyone, anywhere to view and download a digital copy of the 1871 first edition of Middlemarch that is in the collection of the Bodleian Library at Oxford. Everyone profited, including Google, which collected revenue from some discreet advertising attached to the service, Google Book Search. Google also digitized an ever-increasing number of library books that were protected by copyright in order to provide search services that displayed small snippets of the text. In September and October 2005, a group of authors and publishers brought a class action suit against Google, alleging violation of copyright. Last October 28, after lengthy negotiations, the opposing parties announced agreement on a settlement, which is subject to approval by the US District Court for the Southern District of New York.[2]

 

The settlement creates an enterprise known as the Book Rights Registry to represent the interests of the copyright holders. Google will sell access to a gigantic data bank composed primarily of copyrighted, out-of-print books digitized from the research libraries. Colleges, universities, and other organizations will be able to subscribe by paying for an "institutional license" providing access to the data bank. A "public access license" will make this material available to public libraries, where Google will provide free viewing of the digitized books on one computer terminal. And individuals also will be able to access and print out digitized versions of the books by purchasing a "consumer license" from Google, which will cooperate with the registry for the distribution of all the revenue to copyright holders. Google will retain 37 percent, and the registry will distribute 63 percent among the rightsholders.

 

Meanwhile, Google will continue to make books in the public domain available for users to read, download, and print, free of charge. Of the seven million books that Google reportedly had digitized by November 2008, one million are works in the public domain; one million are in copyright and in print; and five million are in copyright but out of print. It is this last category that will furnish the bulk of the books to be made available through the institutional license.

 

Many of the in-copyright and in-print books will not be available in the data bank unless the copyright owners opt to include them. They will continue to be sold in the normal fashion as printed books and also could be marketed to individual customers as digitized copies, accessible through the consumer license for downloading and reading, perhaps eventually on e-book readers such as Amazon's Kindle.

 

After reading the settlement and letting its terms sink in—no easy task, as it runs to 134 pages and 15 appendices of legalese—one is likely to be dumbfounded: here is a proposal that could result in the world's largest library. It would, to be sure, be a digital library, but it could dwarf the Library of Congress and all the national libraries of Europe. Moreover, in pursuing the terms of the settlement with the authors and publishers, Google could also become the world's largest book business—not a chain of stores but an electronic supply service that could out-Amazon Amazon.

 

An enterprise on such a scale is bound to elicit reactions of the two kinds that I have been discussing: on the one hand, utopian enthusiasm; on the other, jeremiads about the danger of concentrating power to control access to information.

 

Who could not be moved by the prospect of bringing virtually all the books from America's greatest research libraries within the reach of all Americans, and perhaps eventually to everyone in the world with access to the Internet? Not only will Google's technological wizardry bring books to readers, it will also open up extraordinary opportunities for research, a whole gamut of possibilities from straightforward word searches to complex text mining. Under certain conditions, the participating libraries will be able to use the digitized copies of their books to create replacements for books that have been damaged or lost. Google will engineer the texts in ways to help readers with disabilities.

 

Unfortunately, Google's commitment to provide free access to its database on one terminal in every public library is hedged with restrictions: readers will not be able to print out any copyrighted text without paying a fee to the copyright holders (though Google has offered to pay them at the outset); and a single terminal will hardly satisfy the demand in large libraries. But Google's generosity will be a boon to the small-town, Carnegie-library readers, who will have access to more books than are currently available in the New York Public Library. Google can make the Enlightenment dream come true.

 

But will it? The eighteenth-century philosophers saw monopoly as a main obstacle to the diffusion of knowledge —not merely monopolies in general, which stifled trade according to Adam Smith and the Physiocrats, but specific monopolies such as the Stationers' Company in London and the booksellers' guild in Paris, which choked off free trade in books.

 

Google is not a guild, and it did not set out to create a monopoly. On the contrary, it has pursued a laudable goal: promoting access to information. But the class action character of the settlement makes Google invulnerable to competition. Most book authors and publishers who own US copyrights are automatically covered by the settlement. They can opt out of it; but whatever they do, no new digitizing enterprise can get off the ground without winning their assent one by one, a practical impossibility, or without becoming mired down in another class action suit. If approved by the court—a process that could take as much as two years—the settlement will give Google control over the digitizing of virtually all books covered by copyright in the United States.

 

This outcome was not anticipated at the outset. Looking back over the course of digitization from the 1990s, we now can see that we missed a great opportunity. Action by Congress and the Library of Congress or a grand alliance of research libraries supported by a coalition of foundations could have done the job at a feasible cost and designed it in a manner that would have put the public interest first. By spreading the cost in various ways—a rental based on the amount of use of a database or a budget line in the National Endowment for the Humanities or the Library of Congress—we could have provided authors and publishers with a legitimate income, while maintaining an open access repository or one in which access was based on reasonable fees. We could have created a National Digital Library—the twenty-first-century equivalent of the Library of Alexandria. It is too late now. Not only have we failed to realize that possibility, but, even worse, we are allowing a question of public policy—the control of access to information—to be determined by private lawsuit.

 

While the public authorities slept, Google took the initiative. It did not seek to settle its affairs in court. It went about its business, scanning books in libraries; and it scanned them so effectively as to arouse the appetite of others for a share in the potential profits. No one should dispute the claim of authors and publishers to income from rights that properly belong to them; nor should anyone presume to pass quick judgment on the contending parties of the lawsuit. The district court judge will pronounce on the validity of the settlement, but that is primarily a matter of dividing profits, not of promoting the public interest.

 

As an unintended consequence, Google will enjoy what can only be called a monopoly—a monopoly of a new kind, not of railroads or steel but of access to information. Google has no serious competitors. Microsoft dropped its major program to digitize books several months ago, and other enterprises like the Open Knowledge Commons (formerly the Open Content Alliance) and the Internet Archive are minute and ineffective in comparison with Google. Google alone has the wealth to digitize on a massive scale. And having settled with the authors and publishers, it can exploit its financial power from within a protective legal barrier; for the class action suit covers the entire class of authors and publishers. No new entrepreneurs will be able to digitize books within that fenced-off territory, even if they could afford it, because they would have to fight the copyright battles all over again. If the settlement is upheld by the court, only Google will be protected from copyright liability.

 

Google's record suggests that it will not abuse its double-barreled fiscal-legal power. But what will happen if its current leaders sell the company or retire? The public will discover the answer from the prices that the future Google charges, especially the price of the institutional subscription licenses. The settlement leaves Google free to negotiate deals with each of its clients, although it announces two guiding principles: "(1) the realization of revenue at market rates for each Book and license on behalf of the Rightsholders and (2) the realization of broad access to the Books by the public, including institutions of higher education."

 

What will happen if Google favors profitability over access? Nothing, if I read the terms of the settlement correctly. Only the registry, acting for the copyright holders, has the power to force a change in the subscription prices charged by Google, and there is no reason to expect the registry to object if the prices are too high. Google may choose to be generous in it pricing, and I have reason to hope it may do so; but it could also employ a strategy comparable to the one that proved to be so effective in pushing up the price of scholarly journals: first, entice subscribers with low initial rates, and then, once they are hooked, ratchet up the rates as high as the traffic will bear.

 

Free-market advocates may argue that the market will correct itself. If Google charges too much, customers will cancel their subscriptions, and the price will drop. But there is no direct connection between supply and demand in the mechanism for the institutional licenses envisioned by the settlement. Students, faculty, and patrons of public libraries will not pay for the subscriptions. The payment will come from the libraries; and if the libraries fail to find enough money for the subscription renewals, they may arouse ferocious protests from readers who have become accustomed to Google's service. In the face of the protests, the libraries probably will cut back on other services, including the acquisition of books, just as they did when publishers ratcheted up the price of periodicals.

 

No one can predict what will happen. We can only read the terms of the settlement and guess about the future. If Google makes available, at a reasonable price, the combined holdings of all the major US libraries, who would not applaud? Would we not prefer a world in which this immense corpus of digitized books is accessible, even at a high price, to one in which it did not exist?

 

Perhaps, but the settlement creates a fundamental change in the digital world by consolidating power in the hands of one company. Apart from Wikipedia, Google already controls the means of access to information online for most Americans, whether they want to find out about people, goods, places, or almost anything. In addition to the original "Big Google," we have Google Earth, Google Maps, Google Images, Google Labs, Google Finance, Google Arts, Google Food, Google Sports, Google Health, Google Checkout, Google Alerts, and many more Google enterprises on the way. Now Google Book Search promises to create the largest library and the largest book business that have ever existed.

Whether or not I have understood the settlement correctly, its terms are locked together so tightly that they cannot be pried apart. At this point, neither Google, nor the authors, nor the publishers, nor the district court is likely to modify the settlement substantially. Yet this is also a tipping point in the development of what we call the information society. If we get the balance wrong at this moment, private interests may outweigh the public good for the foreseeable future, and the Enlightenment dream may be as elusive as ever.

[1]The Copyright Term Extension Act of 1998 retroactively lengthened copyright by twenty years for books copyrighted after January 1, 1923. Unfortunately, the copyright status of books published in the twentieth century is complicated by legislation that has extended copyright eleven times during the last fifty years. Until a congressional act of 1992, rightsholders had to renew their copyrights. The 1992 act removed that requirement for books published between 1964 and 1977, when, according to the Copyright Act of 1976, their copyrights would last for the author's life plus fifty years. The act of 1998 extended that protection to the author's life plus seventy years. Therefore, all books published after 1963 remain in copyright, and an unknown number—unknown owing to inadequate information about the deaths of authors and the owners of copyright—published between 1923 and 1964 are also protected by copyright.
